As employers when you hire a new employee is vital that you give them written details of the terms and conditions of their employment with you. Sometimes these written particulars of employment are referred to as a letter of appointment… and sometimes the term employment contract… or contract of employment… is used instead. These terms are more or less synonymous with one another. It is a legal requirement that you provide employees with certain prescribed written details regarding the terms and conditions of their employment with you. These must be provided by the first day of their employment with you… in other words by commencement date. The employee must agree to and sign this document. A copy must be given to the employee and another copy kept by the employer. The employer must retain this document for at least three years after the employee no longer works for the employer… in other words after termination date. In this tutorial we will consider which laws govern these written particulars of employment and what these written particulars are.
