In South Africa we have a system of precedent known as the stare decisis rule. This provides that the decisions of higher courts are binding on lower courts and must be followed by them. This system of precedent provides for a logical and ordered system of decision-making where courts are accountable for their decisions, and it also prevents a situation where numerous conflicting decisions would be made if the various courts were allowed simply to make decisions as they pleased. To understand completely how this doctrine works however, we need to examine the hierarchy of the courts from highest to lowest. This tutorial entitled “The Courts of Law”, will do just that.
